Due to substantial delays by U.S. Citizenship and Immigration Services (USCIS) processing U Visa applications for Form I-918, USCIS instituted a new policy on reviewing pending U Visa applications to determine if an application has a high probability of approval being considered a bona fide application. When an application is considered bona fide, USCIS may issue a work authorization document also known as an EAD while the main U Visa application is being processed. Finally, these applications are reviewed at the discretion of USCIS and there is no way to request for USCIS to conduct this review to attempt to obtain the EAD sooner.
