A Second Chance for a Military Family

At Barrera Legal Group, we are proud to announce another meaningful victory — the approval of a Form I-601 Waiver of Inadmissibility for one of our clients in a military parole in place adjustment of status case.
Our client and his wife had once made the difficult and desperate decision to bring their young children into the United States without legal status. While this act was wrong under the law, it was driven by a parent’s instinct to protect and reunite the family. USCIS later classified this act as alien smuggling, which can make someone inadmissible and ineligible for lawful permanent residency.
However, under INA § 212(d)(11), the law allows for a discretionary waiver when the person only assisted their own spouse, parent, or child to enter the United States. This provision recognizes the humanitarian reality that many parents act out of fear and love — not for profit or exploitation. Our client qualified under this narrow exception, and the evidence overwhelmingly supported approval.
Through careful preparation and a strong showing of family ties, good moral character, and humanitarian need, our team demonstrated that forgiveness was warranted. USCIS granted the waiver, clearing the path toward adjustment of status and permanent residency.
This case serves as a reminder that even when mistakes are made, the law provides a second chance for families who choose to make things right.
